Terms of Service

These Terms govern your use of the Portfolio Explainer mobile application ("the App") and related backend services provided by Excludium. By creating an account you agree to these Terms. If you do not agree, do not use the App.
1. Educational purpose — not financial advice
Portfolio Explainer is an educational tool. The reports, chat replies, and other AI-generated content provided by the App are explanations of market events — they are not investment advice, financial advice, tax advice, or solicitations to buy or sell any security or crypto-asset.
- We do not recommend specific trades, allocations, or counterparties.
- We do not have a fiduciary relationship with you.
- We do not connect to exchanges, wallets, or any brokerage; the App cannot execute trades.
- Crypto-assets are volatile and may lose all value. Past performance does not predict future results.
You are solely responsible for your own investment decisions. Consult a qualified financial, tax, or legal professional before making any decisions based on information from the App.
2. Accounts
You authenticate via Sign in with Apple or Sign in with Google. You are responsible for maintaining the security of the device and account you use. Notify us immediately at excludiumgc@gmail.com of unauthorized access.
The App is intended for users aged 18 and above. You must be legally capable of forming a binding contract in your jurisdiction.
3. Acceptable use
You agree not to:
- Reverse engineer, scrape, or probe the App or backend for vulnerabilities.
- Attempt to bypass rate limits, entitlement checks, or authentication.
- Use the App for activities that are illegal in your jurisdiction, or that violate third-party rights.
- Interfere with other users' access to the App.
4. Subscriptions
Premium features are available through subscriptions processed by Apple App Store (iOS) or Google Play (Android). By subscribing you agree to the applicable platform's billing terms:
- Charges are billed through your Apple ID / Google account.
- Subscriptions renew automatically at the end of each period until cancelled. To avoid renewal, cancel at least 24 hours before the current period ends via your Apple ID / Google subscription settings.
- Refunds are governed by the applicable platform's policy. We cannot issue refunds directly for App Store / Google Play transactions.
- Price, currency, and features may vary by region.
5. Generated content
Reports and chat replies are produced by large language models (currently OpenAI). They may be inaccurate, incomplete, or outdated. We do not guarantee correctness of any AI-generated content. Do not rely on it for critical decisions without independent verification.
6. Intellectual property
The App, backend, brand, and associated content are owned by Excludium and licensed — not sold — for personal, non-commercial use while your account is active. Portfolio data you enter remains yours.
7. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE CONTENT WILL BE ACCURATE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCLUDIUM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES ARISING FROM YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID US FOR SUBSCRIPTIONS IN THAT PERIOD.
9. Termination
You may delete your account at any time in-app or via pfexplainer.excludium.com/api/legal/account-deletion. We may suspend or terminate accounts that violate these Terms, with or without notice.
10. Platform-specific notices
Apple: Apple is not a party to these Terms and has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Google: Use of the Android build is additionally subject to the Google Play Terms of Service.
11. Changes
We may update these Terms. Material changes will be announced in the App and reflected here with a new "Last updated" date. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws applicable at our place of operation, without regard to conflict-of-law principles. Disputes not resolved informally may be brought in the competent courts at our place of operation.
